Legal Obligations of Developers
- Many people who have lived abroad are making Jamaica their home. Some are Jamaicans who have been living abroad and now desire to return home. Many of them with hard-earned money that they have saved to buy a house here in Jamaica.
One of the popular methods of purchase has been to make a deposit to a Developers who is developing a housing scheme. When the time comes for the owner to take charge of the house, they sometimes run into problems with the Developers. The main problem that they encountered is that the finished product is not what they ordered or built to any reasonable standard.
- Last year December the Appeal Court rule on the matter and this is the main part of the ruling I think. It said, "where land and a house in the course of erection is sold by the builder there is an implied warranty that the house will be completed in a proper and workmanlike manner and will be reasonably fit for human habitation." So it ordered a Developer to return their client deposit with 25% interest for each of the three years that they hold the money.
